I the breeder Wendy Jensen do hereby guarantee to said Purchaser ___________________________________ that in the event the dog purchased from myself develops debilitating Hip Dysplaysia, as defined in this contract, The terms and conditions listed below will apply, if all facets of this contract have been met by all parties involved.  If the new owner, fails to fulfill any part of his/her responsibility of this contract, there will be no further guarantee issued, and the contract will be deemed broken and the guarantee will be null and void.  The terms are as follows:

 

1.                  Purchaser must prove that the dog with the alleged disease is from the breeding listed above, by producing the dog already identified by microchip to have been the pup purchased on the date of ___________ and micro chipped by a licensed Vet as described in the next paragraph. 

For this contract to be honored, this puppy must be permanently identified by the process of micro chipping by a licensed Vet within two weeks of today's date _________.  The purchaser must provide the breeder with written proof of the implant of the chip by the Vet, and with the ID# of the puppy.  The chip info shall be provided to the breeder no later than 4 weeks from the pick up date of the puppy.  If it is not received within 4 weeks, or if the owner fails to, or chooses not to have the pup micro chipped for whatever reason, the guarantee is null and void. 

2.                  Breeder offers a 24 month replacement contract against: Hereditary Malformation of the Hip Joint.  This does not guarantee against any form of subluxation, nor does it apply to any dog that is diagnosed with moderate or less, Hip Dysplaysia.  This guarantee applies only to a dog that is diagnosed with serious/severe crippling Hip Dysplaysia, which has caused in turn a debilitating effect on the dog within the first 24 months.  The Hip Joint must be diagnosed as malformed by a licensed Vet within the time frame allotted in this contract.  Not under any circumstances does this contract cover any environmentally caused Dysplaysia, and in no way will the breeder guarantee the puppy if there is evidence of any accidents, malnutrition, lack of (or not proper) exercise, abuse or other conditions, ailments, diseases, etc.  The breeder does not offer any other physical or genetic guarantees whatsoever on the above puppy.

3.                  Verification of crippling HD must be completed on or before the dogs second Birthday. 

4.                  Diagnosis must be made by a Licensed Vet, and submitted to the breeder by the attending Vet within 15 days of the initial diagnosis.  The diagnosis must be in writing and provided, along with the original x-rays, to the breeder.  When all the terms of this contract have been met within the time periods allowed according to this agreement then the breeder will replace said dog with another puppy of the same Breed, Sex, Color, Quality, registration etc. and under the same terms, as soon as possible, or if no pup is immediately available, breeder will meet these requirements as soon as a pup of similarity is available.  As we do not always have litters on the ground, the replacement process may take some time and Owner shall comply with this timing uncertainty. 

5.                  This contract is only valid as long as the breeder is breeding this breed, and is not transferable by either party.  Should the above mentioned dog be sold or change owners the contract is deemed null and void. 

6.                   Under no circumstances will any money refunds be issued. 

7.                  For this contract to be valid, the owner must have the puppy consistently on NuJoint Plus and NuVet Labs Vitamin/Mineral/Herb formula for the first two years (800-474-7044 code 80923). (This is to ensure that any Dysplaysia is not the result of poor nutrition) The breeder is notified by NuVet labs of all orders.
 

We the undersigned, have read and understand this contract, and agree to its terms and conditions.  The written terms of this contract constitute the entire agreement between Buyer and Breeder, Owners and Co-Owners, and no other written or verbal promises, documents, or writings shall have any weight of effect on this contract.
